GENERAL TERMS AND CONDITIONS
JOS Safety Solutions and Plant Training
1. GENERAL
1.1 These Terms and Conditions form the basis of all contracts with JOS Safety Solutions and Plant Training (“the Company”), unless otherwise agreed in writing.
1.2 All bookings must be confirmed by the Client in writing and accompanied by the required payment.
1.3 The Company reserves the right to amend these Terms and Conditions at any time without notice. The latest version will be available on request or via the Company website.
2. PLANT, EQUIPMENT & PPE
2.1 All plant and equipment used for training must be fully serviceable. All lifting appliances and accessories must be in good condition and, where applicable, have current test certificates.
2.2 Training areas must be isolated from active working zones and clearly marked.
2.3 The Company reserves the right to refuse training if these conditions are not met. In such cases, the full course fee will still be charged.
2.4 Certain courses may require additional equipment or arrangements. These will be discussed prior to training.
2.5 Candidates must supply suitable PPE, including safety boots, hard hat, and hi-vis vest.
3. PERSONNEL
3.1 Due to the nature of equipment operation, candidates must arrive rested and not under the influence of alcohol, drugs, or any impairing medication.
3.2 If a candidate is taking medication that may affect their ability, the Company must be informed in advance.
3.3 The Company reserves the right to refuse training to any person deemed unfit. No refund will be issued in such cases.
4. DATA PROTECTION
4.1 The Client agrees that the Company may hold personal information about delegates as part of its business records.
4.2 The Company complies with the Data Protection Act and all applicable legislation.
5. FORCE MAJEURE
5.1 If the Company is unable to provide any course, or part of a course, due to circumstances beyond its reasonable control, the Company may postpone or cancel the course.
5.2 The Company will attempt to agree an alternative date with the Client but is not obligated to do so.
5.3 If rescheduling cannot be agreed, cancelled training will not be charged and any advance payment for that element will be refunded.
6. NVQ BOOKINGS
6.1 A deposit is required to secure NVQ registration, training dates, or test dates.
6.2 Balancing payments must be made by the date stated on the invoice.
6.3 A pre-course induction will take place after NVQ registration fees have been paid.
6.4 Training duration provided is a guideline only and depends on candidate ability.
6.5 The Company accepts no responsibility for training undertaken elsewhere that does not prepare a candidate adequately for assessment.

7. PLANT NVQs
7.1 NVQ registrations will only be processed once payment has been received.
7.2 Required candidate details include: Full Name, Date of Birth, CPCS Number, National Insurance Number, Contact Number, and Home Address.
7.3 Missing details may delay registration.
7.4 Cards (extensions or blue cards) will be sent to the address provided unless otherwise instructed.
7.5 Candidates/employers must notify the Company of any change of address. If a card is sent to an outdated address, a replacement fee of £35 + VAT will apply.
8. NVQ CANCELLATIONS & REFUNDS
8.1 Cancelling a site visit with an assessor less than 48 hours before the appointment may incur a charge.
8.2 If a refund is requested after NVQ registration, a partial refund will be given (minus fees and any issued card extensions).
8.3 Refunds before registration will be issued in full.
8.4 Cancellations must be made at least 48 hours prior to a site visit.
8.5 Failure to attend a site visit without notice will result in a fee, payable before completion of the NVQ.
9. NVQ CERTIFICATION
9.1 Certificates will only be issued once all payments have been received.
9.2 It is the responsibility of the candidate/employer to allow sufficient time for NVQ completion prior to card expiry. Blue cards may take up to six weeks to arrive.
9.3 The Company is not responsible for site access refusal due to expired cards.
9.4 The Company is not liable for certificates/cards lost in the post. Candidates must notify the Company promptly if items have not been received.
9.5 Replacement cards sent due to outdated address details will incur a £35 + VAT fee.
10. NVQ PAYMENTS
10.1 A deposit is required to secure registration and test dates.
10.2 Late payments may incur interest charges.
10.3 If training is due to take place within five days, full payment is required in advance.
10.4 If invoices are not paid on time, the Company reserves the right to cancel courses/tests.
10.5 Any retainers paid are non-refundable if cancellation occurs due to non-payment.
10.6 Certifications may be withheld until all fees are settled.
10.7 VAT will be charged at the appropriate rate unless the customer provides proof of exemption.
10.8 Payments are accepted via bank transfer, BACS, or cash.
11. NPORS – ON-SITE REQUIREMENTS
11.1 The customer is responsible for ensuring their site meets all NPORS requirements.
11.2 If a site is deemed unsuitable by the instructor, the Company may cancel the test/course.
11.3 A free reschedule will be offered for the first unsuitable attempt; additional attempts will incur charges.
12. NPORS – CANCELLATION & RESCHEDULING
12.1 Cancellations – 5 Working Days’ Notice
Cancellations made at least five working days before the test/course will receive a full refund.
12.2 Cancellations – Less Than 5 Working Days
Late cancellations will incur an administration fee, machine costs, and instructor fees.
12.3 No Notice / No Show
No refund will be given if a candidate fails to attend without communication.
12.4 Company Cancellation
If the Company cancels due to circumstances outside its control (e.g., power failure, security alert, extreme weather), an alternative date will be offered.
12.5 Rescheduling
Rescheduling must be done at least five working days in advance.
Late rescheduling will incur administrative, machine, and instructor fees.
13. IN-HOUSE TRAINING – CANCELLATIONS & RESCHEDULING
13.1 A five working day notice period applies to all cancellations and reschedules.
13.2 Cancellations with at least five working days’ notice receive a full refund.
13.3 Late cancellations will incur administration, machine and instructor fees.
13.4 No-shows without notice will incur a fee.
13.5 If the Company must cancel due to circumstances outside its control, an alternative date will be offered.
13.6 Rescheduling within the five-day penalty window will incur charges.
13.7 Course joining instructions will provide course dates, start times, equipment requirements and directions. The Company is not responsible for candidates failing to read joining instructions.
14. DATA PROTECTION & PRIVACY
14.1 All personal data is handled in accordance with the Data Protection Act 2018.
14.2 Candidate information is collected solely for booking courses and tests, and for feedback.
14.3 Testimonials may be used on the website or social media only with signed permission.
14.4 Data will not be shared with third parties for marketing.
14.5 Candidates may request a copy of the personal data held by the Company and request corrections (a small fee may apply).
15. COPYRIGHT
15.1 All content on the Company website, unless uploaded by users, is the property of JOS Safety Solutions and Plant Training.
15.2 No content may be reproduced, copied, distributed, or stored without express written permission from the Company.
